Extraordinary Ability

National Interest Waiver

For advanced-degree professionals or those with exceptional ability whose work serves the US national interest. The NIW waives the job offer and labor certification. Eligibility follows the three-prong Matter of Dhanasar test:

  • Your endeavor has substantial merit and national importance
  • You are well positioned to advance that endeavor
  • On balance, it benefits the US to waive the job-offer requirement
