1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of The VisaWizard (the "Service"). By creating an account, uploading a resume, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service Does

The VisaWizard is an AI-powered platform that analyzes the resume and information you submit and generates a preliminary assessment of your potential eligibility for certain U.S. employment-based immigration pathways (currently EB-1A and EB-2 NIW). The Service produces informational output to help you understand and prepare your case; it does not file petitions, guarantee outcomes, or represent you before any government agency.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information and to use the Service only for lawful purposes and in accordance with these Terms.

4. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may sign in using email and password or a supported third-party provider (e.g., Google).

5. Packages, Tokens & Payments

Certain evaluations require a paid package or available evaluation credits ("tokens" / attempts). Prices and package contents are shown at the point of purchase. Payments are processed by our third-party payment provider (Stripe); we do not store your full card details.

Because evaluations are delivered digitally and consume computing resources as soon as they are run, purchases are generally non-refundable except where a refund is required by applicable law or expressly stated by us in writing. If you believe you were charged in error, contact us and we will review the matter in good faith.

6. Acceptable Use

You agree not to:

  • Submit content that is unlawful, fraudulent, or that you do not have the right to submit;
  • Upload another person's resume or personal data without their permission;
  • Attempt to probe, scan, overload, or circumvent the security of the Service;
  • Reverse engineer, scrape, or resell the Service or its output except as permitted by law;
  • Use the Service to violate any applicable law or regulation.

7. No Legal Advice; No Attorney–Client Relationship

The VisaWizard is not a law firm and does not provide legal advice. Using the Service does not create an attorney–client relationship. The assessments are general, preliminary, and non-binding, and are not a substitute for advice from a licensed immigration attorney. Immigration outcomes depend on your individual circumstances and the discretion of USCIS and other authorities. You should consult a qualified attorney before making decisions about your case.

8. AI-Generated Content & Accuracy

Assessments are produced by automated systems and large-language-model providers and may contain errors, omissions, or outdated information. We do not warrant that any assessment is accurate, complete, or suitable for a particular purpose. You are responsible for reviewing and verifying any output before relying on it. See our Privacy Policy for how your resume is processed by these providers.

9. Intellectual Property

The Service, including its software, design, and content (excluding content you submit), is owned by The VisaWizard or its licensors and is protected by intellectual-property laws. You retain ownership of the resume and information you submit, and you grant us a limited license to process it solely to provide the Service to you.

10. Third-Party Services

The Service relies on third-party providers (for example, payment processing, authentication, and AI model providers). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, The VisaWizard and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless The VisaWizard from any claims, damages, liabilities, and expenses arising out of your use of the Service, your submitted content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including payment, disclaimers, limitation of liability, and indemnification) will survive.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or relating to them or the Service, are governed by the laws of the State of New York, including its conflict-of-laws rules. Subject to Section 17 below, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of New York, and you consent to the personal jurisdiction and venue of those courts, unless applicable law requires otherwise.

17. Dispute Resolution; Mediation First

Before initiating any legal action or proceeding arising out of or relating to these Terms or the Service, the parties agree to first attempt in good faith to resolve the dispute through mediation. The mediation shall be conducted in the State of New York (or remotely, if the parties agree) before a mutually agreed mediator, with the costs of the mediator shared equally by the parties. If the dispute is not resolved through mediation within sixty (60) days of a party's written request for mediation, either party may pursue the dispute in the courts identified in Section 16. Nothing in this section prevents either party from seeking temporary or preliminary equitable relief where necessary to prevent irreparable harm.
